What are the penalties for driving while intoxicated or driving under the influence (39:4-50)?

  • First offense with a blood-alcohol content (BAC) of .08 percent or higher but less than .10 percent, or an observation case (no alcotest): $250–$400 fine and 12 to 48 hours' detainment (per Intoxicated Driver Resource Center requirements); and in the court's discretion, up to 30 days' imprisonment; also a three-month suspension of driver's license; also may order supervised visitation program and may order installation of ignition interlock device for six months to one year; also must satisfy Intoxicated Driver Resource Center (IDRC) requirements.
  • First offense with a blood-alcohol content (BAC) of .10 percent or higher or under the influence of drugs: $300–$500 fine and 12 to 48 hours' detainment (per Intoxicated Driver Resource Center requirements); and in the court's discretion, up to 30 days' imprisonment; also a seven-month to one-year suspension of driver's license; also may order supervised visitation program and may order installation of ignition interlock device for six months to one year; also must satisfy Intoxicated Driver Resource Center (IDRC) requirements.
  • Second offense: (If second offense occurs more than 10 years after first conviction, it shall be treated as a first offense.) $500–$1,000 fine, 30 days' community service, 48 hours' to 90 days' imprisonment, two years' suspension of driver's license, and shall order installation of ignition interlock device for one to three years or revoke registration certificates and plates for two years; also may order supervised visitation program; also must satisfy IDRC requirements.
  • Third or subsequent offense: (If third offense occurs more than 10 years after second conviction, it shall be treated as a second offense.) $1,000 fine and 180 days' imprisonment (court may order 90 days of sentence participating in drug or alcohol rehabilitation program) and 10 years' suspension of driver's license, and shall order installation of ignition interlock device for one to three years or revoke registration certificates and plates for 10 years; also may order supervised visitation program; also must satisfy IDRC requirements.

What are the penalties for refusal to undergo or submit to a chemical breath test (39:4-50a)?

The following penalties are in addition to the fines and penalties imposed for a conviction for DWI/DUI:

  • First offense: $300–$500 fine and referral to IDRC and seven months to one year suspension of driver's license
  • Second offense: $500–$1,000 fine and referral to IDRC and two years' suspension of driver's license
  • Third or subsequent offense: $1,000 and referral to IDRC and 10 years' suspension of driver's license

What are the penalties for a violation while or within 1,000 feet of school property or at a school crossing?

  • First offense: $500-800 and up to 60 days imprisonment and one to two years' suspension of driver's license; also installation of ignition interlock device for six months to one year; also must satisfy IDRC requirements.
  • Second offense: $1,000-$2,000 and at least 96 hours and up to 180 days' imprisonment (term may be lowered for community service) and 60 days community service and at least four years' suspension of driver's license; may order ignition interlock device for one to three years; also must satisfy IDRC requirements.
  • Third offense: $2,000 and 180 days imprisonment; court may also order 90 days' sentence in drug or alcohol rehabilitation; also must satisfy IDRC requirements

What are the penalties for operation by a person who has consumed alcohol who is below the legal age to purchase alcoholic beverages?

  • BAC of .01-.08 percent: In addition to penalties under any other law; 30-90 days loss of license and 15-30 days community service; must also satisfy IDRC program and fee requirements or participate in program of alcohol and highway safety.
